AGREEMENT TO OUR LEGAL TERMS

These Terms & Conditions constitute a legally binding agreement between you (“you”, “your”, or “customer”) and SPOODIES UK LTD (Company No. 16755480) (“Company”, “we”, “us”, or “our”).

We operate the websites Spoodies.com, Spoodies.uk, and Spoodyliscious.uk, together with any associated online store, products, services, or communications (collectively referred to as the “Services”).

By accessing, browsing, or purchasing from our Services, you confirm that you have read, understood, and agreed to be bound by these Terms & Conditions.

If you do not agree with these Terms & Conditions, you must stop using our Services immediately.

We reserve the right to amend or update these Terms & Conditions at any time without prior notice. Changes will take effect immediately upon publication on our website.

Our Services are intended only for persons aged 18 years or older.

1. OUR SERVICES

Our Services provide online retail sales of livestock, invertebrates, accessories, feeders, enclosures, and related products within the United Kingdom and other approved regions.

Information provided on our websites is for general informational purposes only. Customers accessing our Services outside the United Kingdom do so at their own risk and are responsible for compliance with local laws, regulations, and import requirements.

2. INTELLECTUAL PROPERTY RIGHTS

All content included within our Services, including logos, branding, product descriptions, graphics, images, website design, text, software, and media, is owned by or licensed to SPOODIES UK LTD and is protected under intellectual property laws.

You may access and use our Services for personal, non-commercial use only.

You may not reproduce, copy, distribute, modify, republish, sell, or commercially exploit any part of our Services without prior written permission.

3. USER REPRESENTATIONS

By using our Services, you confirm that:

  • You are at least 18 years old

  • All information provided by you is accurate and current

  • You will use our Services lawfully

  • You will not misuse or interfere with the operation of our Services

We reserve the right to suspend or terminate access to customers who breach these Terms & Conditions.

4. USER REGISTRATION

Certain features of our Services may require account registration.

You are responsible for maintaining the confidentiality of your account information and password and for all activity conducted under your account.

We reserve the right to suspend, restrict, or remove accounts at our discretion.

5. PRODUCTS

We make every effort to ensure product descriptions, pricing, availability, and images are accurate. However, we do not guarantee that all information will always be current, complete, or error-free.

All products are subject to availability and may be withdrawn at any time without notice.

5.1 Product Images & Representation

Product images are provided for illustrative purposes only. Colours, sizes, and appearances may vary slightly from the actual product received.

Stock images may occasionally be used and may not represent the exact item supplied.

5.2 Livestock Images & Selection

Images of livestock are illustrative only and may not depict the exact animal received.

Unless specifically stated otherwise, livestock will be selected at random from available stock.

5.3 Substitutions

Where an item becomes unavailable after purchase, we reserve the right to provide a suitable substitute of equal or greater value.

5.4 Customer Requests

We will make reasonable efforts to accommodate customer requests, but these cannot be guaranteed.

5.5 Unavailable Orders

If we cannot fulfil an order or request, we will attempt to contact you. If no response is received within 24 hours, the order may be cancelled and refunded.

6. PURCHASES & PAYMENT

We accept payment through approved payment providers including:

  • Visa

  • Mastercard

  • PayPal

  • Stripe

  • MONZO Payment Link

All prices displayed are in GBP (£).

You agree to provide current, complete, and accurate billing and payment information.

We reserve the right to refuse, cancel, or limit any order at our discretion.

7. DELIVERY, RETURNS & DOA POLICY

All livestock orders are dispatched using Royal Mail Next Day delivery services.

A signature will be required upon delivery.

It is the customer’s responsibility to ensure that someone is available to receive and sign for the delivery at the shipping address provided.

If a delivery attempt fails for any reason, including but not limited to the recipient being unavailable, any Dead on Arrival (“DOA”) guarantee or claim will become void.

If an order is returned to us due to failed delivery, refusal, incorrect address details, or non-collection, a redelivery charge will apply before the order can be resent.

Any approved replacement shipment issued under our DOA policy will also require payment of a delivery charge.

Spiders and other livestock sold by SPOODIES UK LTD are supplied with a Dead on Arrival (“DOA”) guarantee only. We do not provide any guarantee or warranty relating to lifespan, long-term health, growth, behaviour, moulting success, feeding response, breeding capability, or sustained life after delivery.

By placing an order with us, you acknowledge and agree to these Terms & Conditions and accept full responsibility for the ongoing care, husbandry, and welfare of any livestock purchased.

In the event that a spider or other livestock dies after successful delivery, SPOODIES UK LTD shall not be held responsible or liable for any loss, damage, claim, expense, injury, or compensation of any kind arising from such death.

7.1  chargeback, payment dispute, or bank reversal

 Due to the nature of livestock and perishable products, all sales are final unless otherwise required by law.
By completing your purchase, you expressly waive your right to initiate a chargeback, payment dispute, or bank reversal on the basis that a spider or other livestock item is later considered unsuitable, undesirable, or not meeting personal expectations, provided the order was delivered successfully and in accordance with these Terms & Conditions.

8. USER-GENERATED CONTENT

Where customers submit reviews, comments, photographs, videos, or other content, you grant us permission to use, reproduce, modify, publish, and display such content for business, marketing, and promotional purposes.

Content submitted must not:

  • Be unlawful or misleading

  • Infringe third-party rights

  • Contain abusive, offensive, or discriminatory material

  • Contain malicious software or harmful content

We reserve the right to remove content at our discretion.

9. THIRD-PARTY WEBSITES

Our Services may contain links to third-party websites. We are not responsible for the content, policies, or practices of third-party websites.

Accessing third-party websites is done entirely at your own risk.

10. PRIVACY POLICY

Use of our Services is also governed by our Privacy Policy.

By using our Services, you consent to the collection, storage, and use of information in accordance with our Privacy Policy.

11. TERMINATION

We reserve the right to suspend or terminate your access to our Services at any time and without notice where we reasonably believe you have breached these Terms & Conditions.

12. MODIFICATIONS & INTERRUPTIONS

We reserve the right to modify, suspend, discontinue, or remove any part of our Services at any time without notice.

We are not liable for any temporary unavailability, interruption, delays, or downtime affecting our Services.

13. GOVERNING LAW

These Terms & Conditions are governed by and interpreted in accordance with the laws of England and Wales.

Any disputes arising from these Terms & Conditions shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

14. DISCLAIMER

All Services and products are provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by law, SPOODIES UK LTD disclaims all warranties, representations, and guarantees relating to our Services and products.

We make no guarantee that our Services will always be uninterrupted, secure, or error-free.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by law, SPOODIES UK LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our Services or products.

Our total liability shall not exceed the amount paid by you for the relevant order giving rise to the claim.

16. INDEMNIFICATION

You agree to indemnify and hold harmless SPOODIES UK LTD, its directors, employees, affiliates, and representatives against any claims, damages, liabilities, costs, or expenses arising from:

  • Your misuse of our Services

  • Your breach of these Terms & Conditions

  • Your violation of any law or third-party rights

17. ELECTRONIC COMMUNICATIONS

By using our Services, you consent to receiving electronic communications including emails, invoices, notices, and updates.

Electronic communications satisfy any legal requirement for written communication.

18. MISCELLANEOUS

These Terms & Conditions constitute the entire agreement between you and SPOODIES UK LTD regarding use of the Services.

If any provision of these Terms & Conditions is found to be unlawful or unenforceable, the remaining provisions shall remain valid and enforceable.

Failure by us to enforce any provision of these Terms & Conditions shall not constitute a waiver of our rights.
